Distance Sales Agreement

This agreement governs the terms under which the buyer subscribes digitally to the KurgemX platform. The service is a digital SaaS (Software as a Service) offering that includes story mapping, business analysis document creation, prototyping, and test scenario generation features.

Freemium: $0 — 1 small project per month, max 5 stories Starter: $9/month — 3 projects per month, max 15 stories Pro: $29/month — 10 projects per month, max 40 stories Listed prices include applicable taxes. Prices are in USD; the exchange rate at the time of payment applies.

Paid subscriptions are charged in advance on a monthly billing cycle. Payment is collected automatically via the credit or debit card provided at registration. Subscriptions may be suspended in the event of payment failure.

Under Article 49 of Turkish Consumer Protection Law No. 6502, consumers have the right to withdraw within 14 days of a distance contract. However, where the buyer has requested and explicitly consented to the commencement of service performance before the withdrawal period expires, the right of withdrawal cannot be exercised. Since service performance begins at the moment of subscription activation, the buyer provides explicit consent to this during activation. Accordingly, the right of withdrawal does not apply to this digital content service.

The buyer may cancel their subscription at any time. Cancellation takes effect at the end of the current billing period; access to all features continues until that date. No refunds are issued for unused time. The Freemium plan is free of charge and therefore not subject to refund.

Turkish law governs any disputes arising from this agreement. Istanbul courts and enforcement offices have jurisdiction.
